Terms of Service

1. General provisions

These Terms of Service set out the rules for using the contract90.com website (“Site”), including joining the waitlist for the Contract: 90 launch (“Waitlist”).

The service provider and operator of the Site is:

These Terms are made available free of charge before entering into a contract for electronically-provided services, in a form that allows them to be obtained, reproduced, and recorded (Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means).

2. Definitions

  • Service Provider - Mateusz Bąk Software Solutions (Mbsoft), NIP 8652586384.
  • Site - the website available at contract90.com.
  • User - any person using the Site.
  • Service - the electronically-provided service supplied by the Service Provider to the User through the Site, described in Section 3.
  • Waitlist - the Site’s feature that lets a user submit an email address to receive messages about Contract: 90.
  • Game - the game Contract: 90, ultimately made available at a separate address, game.contract90.com, which is not covered by these Terms.

3. Type and scope of electronically-provided services

Through the Site, the Service Provider provides the following electronic services free of charge:

  • providing informational content about the Game,
  • operating the Waitlist - collecting an email address to send messages about the Game’s development progress, the opening of access, and - after launch - new content and features for the Game, within the scope described in the Privacy Policy.

The Site does not support entering into sales contracts or making payments. Using the Site and joining the Waitlist are free of charge.

Access to the Game itself (including alpha access via an invite code) takes place outside the Site, at game.contract90.com, and will be governed by separate terms made available before the Game launches.

4. Technical requirements

Using the Site requires:

  • a device with internet access,
  • an up-to-date web browser with JavaScript enabled,
  • to join the Waitlist - a working email address.

The Service Provider notes that using electronically-provided services may carry risks typical of the internet (e.g. malicious software, unauthorized access to a User’s device) and recommends using up-to-date security software.

5. Formation and termination of the contract

The contract for the Service (joining the Waitlist) is formed once the User has:

  1. filled in the sign-up form with an email address,
  2. accepted these Terms and the Privacy Policy and given consent to receive the messages described in Section 3,
  3. confirmed the submission by sending the form.

The contract is for an indefinite period and may be terminated at any time and without giving a reason:

  • by the User - by sending a cancellation request to help@contract90.com,
  • by the Service Provider - in particular if the Waitlist is discontinued (e.g. after the Game launches) or if the User breaches Section 6 of these Terms.

Termination is free of charge and stops further messages, subject to the data retention periods described in the Privacy Policy.

6. User obligations

By using the Site, the User agrees to:

  • provide accurate information (including a working email address belonging to them),
  • not submit unlawful content,
  • not take any action that could disrupt the Site or the sign-up form (e.g. automated submissions, attempts to bypass submission limits).

The Site is intended for individuals aged 16 and over. Individuals under 16 may only use the Site with the consent of a parent or legal guardian.

7. Complaints

Complaints about the Site or the Waitlist can be sent to help@contract90.com, with a description of the issue and contact details so we can respond.

Complaints are handled within 14 days of receipt. A response is sent to the email address the complaint was sent from, unless the User provides a different contact method.

8. Liability

The Site is in a pre-launch stage. The Service Provider does not guarantee a specific launch date or a specific set of features for the Game, and reserves the right to change, delay, or cancel the launch.

The Service Provider makes reasonable efforts to keep the Site running continuously and without disruption, but is not liable for outages caused by technical issues, force majeure, or the actions of third parties (e.g. the hosting provider).

Liability of the Service Provider toward a User who is not a consumer is limited to damage caused by intentional misconduct. Liability toward consumers is not limited beyond what is required under applicable mandatory law.

9. Personal data protection

The rules for processing Users’ personal data are set out in a separate document - the Privacy Policy, available at contract90.com/privacy-policy.

10. Intellectual property

The “Contract: 90” name, logo, artwork, screenshots, and content published on the Site are owned by the Service Provider or used under an appropriate license, and are protected by law. Using them beyond what the Site’s functionality provides for requires the Service Provider’s prior consent.

11. Final provisions

The Service Provider reserves the right to amend these Terms for valid reasons (including changes to the services provided, or legal or organizational requirements). Users on the Waitlist will be notified of changes to these Terms by email or via a notice on the Site, at least 7 days before the change takes effect.

Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Act on Providing Services by Electronic Means - though for a User who is a consumer, this does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence, where that protection cannot be excluded by agreement under that law.

A User who is a consumer may use out-of-court methods for handling complaints and pursuing claims, including through municipal or district consumer ombudsmen (Rzecznicy Konsumentów) or regional Trade Inspection authorities (Wojewódzkie Inspektoraty Inspekcji Handlowej).

The current version of these Terms is always available on the Site.
